Guideline Form 8

Purpose of Form: 

To give notice as required under Sections to a registered owner that a benefit, burden or an overriding interest has been added to the parcel register.

 

This form is used by an authorized lawyer to provide notification to a parcel owner of the addition of a benefit, burden or an overriding interest to their parcel unless the parcel owner was a party to the execution of the document which conveys or evidences the benefit or burden as required under Sections 13, 14, 15 and 17 of the Land Registration Administration Regulations.

 

In addition to providing notice of the addition of the interest to the parcel register of the affected PIDs, this form also provides notice to the registered owner(s) that the parcel descriptions for any affected land registration parcels will be amended to reflect the addition of the applicable benefit, burden or overriding interest.

 

The authorized lawyer is required to retain a true copy of the notice in Form 8 along with proof of service in accordance with Section 30 and make available for review by the Registrar General upon request and audit by the Nova Scotia Barristers’ Society.
