Guideline Form 49

 

Purpose of Form:

This form is used to correct an error made on a Request to Record (Form 26), Request to Cancel (Form 27), or on the Lenders Forms 26L & 27L that does not contain a Certificate of Legal Effect (Form 26 or 27 dated prior to May 4, 2009).

 

If the interest being corrected is a document that relates to another document (e.g. assignment, amendment, postponement, renewal, etc., then the original mortgage(s), judgment, etc. must also be provided in the "Reference to Related Instrument" box.  

 

Instrument Type: 822

 

LR or ROD: This form is indexed under the Land Registration system only.

 

Mandatory E-Submission Applies:  No (currently no electronic F49 exists

 

Fee Required: No (not for the form)

Exception:  If a document is attached to this form, then a fee will be applicable

 

Accompanying Instrument Required: No

Note:  The only time a document should be attached to this form is if the original document contained an error and a corrected document is replacing the original.

 

Acceptance Criteria for Form 49:

Note:  The reference must include the document number and year OR the book and page for the document.  If the document number provided is 'unique' (where a document number is 8 digits or more, a year is not required).
